Erie County contracted with Kenford Co. and Dome Stadium, Inc. (DSI) for the construction and operation of a domed stadium. The contract stipulated that if the parties failed to agree on a 40-year lease, a pre-negotiated 20-year management contract would automatically take effect upon the stadium’s completion. The County failed to begin construction, thereby breaching the contract. Kenford and DSI sued for damages, including DSI’s loss of prospective profits over the 20-year term of the management contract. At trial, DSI presented extensive expert testimony using sophisticated economic modeling to project these profits.
