A man named Willie Shard reported being robbed of his wallet, which contained traveler’s checks and a Social Security card. The following day, police officers stopped petitioner Kirby and a companion, Ralph Bean, for an unrelated matter. Upon request for identification, Kirby produced a wallet containing Shard’s property. The officers arrested both men and took them to a police station. Only after arriving at the station did the officers learn of the Shard robbery. They then brought Shard to the station, where he immediately identified Kirby and Bean, who were sitting at a table, as his assailants. This identification was a ‘showup,’ not a lineup. The identification occurred before Kirby had been indicted or formally charged with any crime. No counsel was present for Kirby, nor had he been advised of any right to counsel for the identification procedure. At trial, the prosecution introduced Shard’s testimony about the station-house identification, and Shard also identified Kirby in court. Kirby’s motion to suppress the identification testimony was denied, and he was convicted of robbery.
