In 1997, Jimcy McGirt, an enrolled member of the Seminole Nation of Oklahoma, was convicted in Oklahoma state court of serious sexual offenses. The crimes occurred within the historical boundaries of the Muscogee (Creek) Nation’s territory, which was established through a series of 19th-century treaties with the United States. These treaties “solemnly guarantied” the land to the Creek Nation as a “permanent home” that would be “forever set apart.” In postconviction proceedings, McGirt argued that the State of Oklahoma lacked jurisdiction to prosecute him. He contended that because he is an Indian and his crimes were committed within the boundaries of the Creek Reservation, the case fell under the exclusive jurisdiction of the federal government pursuant to the Major Crimes Act (MCA), 18 U.S.C. § 1153. The State of Oklahoma countered that the Creek Reservation had been disestablished by a series of congressional acts around the time of Oklahoma’s statehood, particularly those implementing the policy of allotting tribal lands to individual members. The state also pointed to over a century of its consistent exercise of criminal jurisdiction over the area as evidence of disestablishment. The Oklahoma Court of Criminal Appeals rejected McGirt’s claim, and the Supreme Court granted certiorari to resolve the question of the reservation’s status.
