The warranty deed creating the life estate stipulated that McIntyre was responsible for maintenance, upkeep, and payment of ad valorem taxes, and that the estate was for her “natural life and during her occupancy of this tract as a personal residence.” Due to declining health, the 90-year-old McIntyre moved into a convalescent home and had not been seen on the property for approximately four years. During her absence, she failed to pay property taxes from 1991 to 1994, forcing the Scarbroughs, as remaindermen, to pay the arrearage to protect their interest. The property fell into disrepair, though McIntyre left her personal belongings and expressed an intent to return. The Scarbroughs sued to terminate the life estate, alleging she had ceased occupancy and committed waste. The trial court granted summary judgment for the Scarbroughs.
