Jones & Laughlin Steel Corp., the nation’s fourth-largest steel producer, was a fully integrated enterprise. It owned mines in Michigan and Minnesota, coal mines in Pennsylvania, and its own transportation network of steamships and railroads to bring raw materials to its manufacturing plants in Pennsylvania. Approximately 75% of its finished steel products were shipped out of state to a national market. The National Labor Relations Board (NLRB), acting under the authority of the National Labor Relations Act (NLRA), found that the corporation had engaged in unfair labor practices by firing ten employees at its Aliquippa, Pennsylvania plant for their union activities. The corporation refused to comply with the NLRB’s order of reinstatement and back pay, arguing that the NLRA was an unconstitutional regulation of local manufacturing activities that fell outside the scope of Congress’s power under the Commerce Clause. The Circuit Court of Appeals agreed with the corporation, and the Supreme Court granted certiorari.
