Following the disappearance of a 10-year-old girl, police initiated a large-scale grid search involving 200 volunteers. The suspect, Robert Williams, surrendered to police in a different city. Williams’s attorney secured an agreement with police that they would not question him during his transport back to Des Moines. In violation of this agreement and Williams’s Sixth Amendment right to counsel, a detective elicited incriminating statements from Williams through the now-famous ‘Christian burial speech.’ These statements led police directly to the child’s body. At the time Williams revealed the location, the organized search party was only two and a half miles away and systematically approaching the area. The search was suspended upon Williams’s cooperation. At his second trial, the prosecution sought to admit evidence of the body’s location and condition, arguing that the search party would have found it regardless of Williams’s unconstitutionally obtained statements.
