Jose Padilla, a lawful permanent resident for over 40 years and a U.S. Armed Forces veteran, was charged with drug trafficking in Kentucky. His defense attorney advised him to plead guilty, affirmatively misrepresenting that Padilla’s long-term residency meant he “did not have to worry about immigration status.” Relying on this advice, Padilla entered a guilty plea. Under the Immigration and Nationality Act, however, Padilla’s conviction made his deportation “virtually mandatory.” Padilla later filed for postconviction relief, alleging ineffective assistance of counsel. He claimed that had he been properly advised of the near-certain deportation consequence, he would have rejected the plea offer and insisted on proceeding to trial. The Supreme Court of Kentucky denied his claim, holding that deportation is a “collateral” consequence of a conviction, and therefore, any advice regarding it falls outside the scope of the Sixth Amendment right to effective counsel. The U.S. Supreme Court granted certiorari.
