Defendant Thomas Luparello, a chiropractor, was distraught after his pregnant lover left him to reconcile with her husband. Luparello hired co-defendant Carlos Orduna and another man, Johnny Salmon, to find her. The plan was to obtain information from Mark Martin, a friend of the lover’s husband. Luparello told them he wanted the information “at any cost” and paid them for their services. Luparello was aware his confederates were armed with deadly weapons (a sword and nunchakus) during an initial, failed attempt to lure Martin from his house to “thump” him. The following evening, Orduna successfully lured Martin out of his house, at which point an accomplice in a nearby car shot and killed Martin. Luparello was not present at the scene of the murder. At trial, Luparello and Orduna were convicted of conspiracy to commit assault and first-degree murder. Luparello appealed, arguing he could not be liable for a murder he did not intend.
