He was arrested in a Manhattan social club for possessing a loaded .38 caliber pistol without a New York license, a violation of Penal Law § 265.02. At trial, Marrero did not dispute possessing the weapon but argued that he was not criminally liable due to a mistake of law. He claimed he mistakenly believed he was exempt from the state’s handgun licensing requirement because he qualified as a “peace officer” under his interpretation of several interconnected New York statutes (Penal Law § 265.20; CPL 2.10, 1.20).
