In a prior case, the First Circuit Court of Appeals reviewed a decision by the Supreme Court of Puerto Rico (PRSC) that had reinstated a district court’s order enjoining certain Puerto Rican officials (petitioners) from spending emergency relief funds. Pending its decision, the First Circuit issued a stay order on August 5, 1944, which effectively suspended the injunction and allowed the officials to continue spending. On October 24, the First Circuit affirmed the PRSC’s decision but, per its rules, its mandate would not issue for 30 days. The court intentionally kept its August 5 stay in effect during this period to allow petitioners time to seek further review. Despite the active federal stay, a Puerto Rican district judge, believing the First Circuit’s affirmance was self-executing, held the petitioners in contempt for continuing to spend funds and ordered their arrest. Other district courts issued similar injunctions. The PRSC intervened by granting certiorari on the contempt order and releasing the petitioners on bail. The petitioners then sought writs of prohibition and mandamus from the First Circuit to compel the Puerto Rican courts to cease these actions, which they argued violated the federal stay.
