Case Brief Summary & Legal Analysis

General Brief
4 min read

tl;dr: A news network broadcast a suspect’s live suicide at the end of a police chase. The suspect’s children sued for emotional distress. The court held the First Amendment protected the broadcast because the chase was a matter of public concern, barring the tort claims.

Legal Significance: Establishes that First Amendment protection for speech on matters of public concern extends to truthful, newsworthy broadcasts of graphic events, even if offensive or harmful, shielding media from tort liability for emotional distress when the broadcast is viewed as a whole.

Case Facts & Court Holding

Key Facts & Case Background

JoDon Romero led police on an 80-mile, high-speed chase after an armed carjacking, at times firing at officers. The chase posed a significant, ongoing threat to public safety. Fox News Network, LLC (Fox) provided live national coverage of the event from a helicopter. At the conclusion of the chase, Romero exited his vehicle and committed suicide by shooting himself in the head. Fox, which typically uses a video delay for live events, failed to do so and broadcast the suicide in its entirety. The anchor immediately apologized on air. Romero’s two teenage sons, who were unaware of their father’s involvement, later heard about a suicide video at school. They found a clip of the Fox broadcast online and, upon viewing it, discovered that the man who killed himself was their father. Their mother, Angela Rodriguez, sued Fox on their behalf, alleging intentional and negligent infliction of emotional distress. The trial court dismissed the complaint, and Rodriguez appealed.
