Jane Roe, a pseudonym for an unmarried pregnant woman, initiated a federal action in Texas challenging the constitutionality of the state’s criminal abortion laws. The Texas statutes criminalized procuring or attempting an abortion except when performed based on medical advice for the purpose of saving the mother’s life. Roe alleged she was unable to obtain a legal abortion because her life was not threatened by the pregnancy and that she could not afford to travel to another jurisdiction.
