Petitioner Justus Rosemond participated in a marijuana sale with two confederates. When the prospective buyers stole the drugs instead of paying, one of Rosemond’s confederates fired a gun at the fleeing buyers. The identity of the shooter was disputed. The government charged Rosemond with violating 18 U.S.C. § 924(c), which criminalizes using or carrying a firearm “during and in relation to” a drug trafficking crime. The prosecution argued two alternative theories: that Rosemond was the principal who fired the gun, or that he was liable for aiding and abetting the offense. The district court instructed the jury that it could find Rosemond guilty of aiding and abetting if he “(1) knew his cohort used a firearm in the drug trafficking crime, and (2) knowingly and actively participated in the drug trafficking crime.” This instruction did not specify that Rosemond needed to have known about the gun before the crime was completed or before he could no longer withdraw. The jury returned a general verdict convicting Rosemond.
