Defendants John and Christina McLean purchased Lot 86 in the Green Lawn subdivision. Their deed contained no restrictions on the use of the property. The original developers of the subdivision, the McLaughlins, had platted 91 lots on Collingwood Avenue with the intent of creating a high-grade residential district. Before selling Lot 86, the McLaughlins sold numerous other lots with deeds containing express restrictions limiting their use to residential purposes only. Over time, all lots on the street were developed with residences, creating a uniform appearance. When the McLeans began constructing a gasoline filling station on the rear of their lot, neighboring property owners, whose titles also traced back to the McLaughlins, sued for an injunction. The McLeans argued they were not bound by any restrictions because none appeared in their chain of title and they had no actual notice. At the time of their purchase, the residential character of the neighborhood was well-established and clearly visible.
