Defendants, the Schechter brothers, operated wholesale poultry slaughterhouses in Brooklyn, New York. They purchased live poultry, almost all of which originated from out-of-state, from commission men at New York City terminals after the poultry had completed its interstate journey. The Schechters then slaughtered the poultry and sold it exclusively to local retailers and butchers within Brooklyn. Their business activities were entirely intrastate. They were convicted of violating the Live Poultry Code, a set of regulations promulgated by the President under the authority of the National Industrial Recovery Act (NIRA). The NIRA authorized the President to approve “codes of fair competition” for trades and industries to effectuate the Act’s broad policy of national economic recovery. The Schechters’ alleged violations included failing to observe the Code’s minimum wage and maximum hour provisions and violating a trade practice rule requiring “straight killing,” which prohibited customers from selecting individual chickens. The Schechters challenged their convictions, arguing the NIRA involved an unconstitutional delegation of legislative power and that their local business was beyond the regulatory reach of Congress under the Commerce Clause.
