Solon Manufacturing Co. (“Solon”) refused to bargain with the United Paperworkers International Union (“the Union”) after the Union won a runoff representation election, prompting an unfair labor practice charge under § 8(a)(5) of the NLRA. Solon’s refusal to bargain was a procedural means to seek judicial review of the Union’s certification. Solon objected to the election based on a union leaflet distributed the day before the vote. The leaflet contained two key elements: (1) an offer stating, “There will be no initiation fees for any member of the bargaining unit who signs up as a charter member,” and (2) statements regarding wages and benefits at other unionized plants. The NLRB Regional Director investigated Solon’s objections without holding an evidentiary hearing, found the Union’s conduct permissible, and recommended overruling the objections. The full Board adopted the director’s findings and certified the Union as the employees’ bargaining representative.
