(“Solon”) refused to bargain with the United Paperworkers International Union (“the Union”) after the Union won a runoff representation election, prompting an unfair labor practice charge under § 8(a)(5) of the NLRA. Solon’s refusal to bargain was a procedural means to seek judicial review of the Union’s certification. Solon objected to the election based on a union leaflet distributed the day before the vote.
