Defendant James Kridel signed a two-year residential lease with plaintiff Abraham Sommer but notified the landlord in writing before the lease term began that he could not take possession due to a broken engagement. Kridel surrendered all rights to the apartment and forfeited the security deposit and first month’s rent he had already paid. Sommer did not respond to Kridel’s letter. Subsequently, a third party inquired about renting the specific apartment but was informed it was unavailable because it was already leased. Sommer made no effort to re-let the apartment for approximately 15 months, at which point it was rented to a new tenant. Sommer then sued Kridel for the entire amount of rent that had accrued during the period the apartment was vacant. The trial court found for Kridel, but the Appellate Division reversed, citing precedent that landlords had no duty to mitigate damages. The Supreme Court of New Jersey granted certification to review this rule.
