The United States government initiated an in rem condemnation action against tablets called “Aangamik 15,” manufactured by FoodScience Laboratories, Inc. The government alleged the tablets were an “adulterated food” under the Federal Food, Drug, and Cosmetic Act (FDCA) because they contained N,N-Dimethylglycine hydrochloride (DMG), which it claimed was an unsafe “food additive” under 21 U.S.C. § 342(a)(2)(C).
