Congress enacted the “Filled Milk Act of 1923,” which prohibited the interstate shipment of skimmed milk combined with any fat or oil other than milk fat, where the resulting product resembled milk or cream. The statute contained a legislative finding that such products were “injurious to the public health” and constituted a “fraud upon the public.” Carolene Products Co. was indicted for violating the Act by shipping its product, “Milnut,” a compound of condensed skimmed milk and coconut oil.
