Appellee Fred W. Darby, a Georgia lumber manufacturer, was indicted for violating the Fair Labor Standards Act of 1938 (FLSA). The FLSA prohibited the shipment in interstate commerce of goods produced by employees whose wages and hours did not meet the Act’s prescribed minimums and maximums. It also directly forbade the employment of workers in the “production of goods for interstate commerce” under such substandard conditions. Darby produced lumber in Georgia, a significant portion of which he shipped to customers in other states. The indictment charged him with shipping lumber produced by employees paid less than the minimum wage and worked for more than the maximum hours, and with failing to keep required employment records. The federal district court, relying on Hammer v. Dagenhart, quashed the indictment, holding that the FLSA was an unconstitutional attempt to regulate local manufacturing, a power reserved to the states by the Tenth Amendment. The United States appealed directly to the Supreme Court.
