Following the indictment of seven of President Richard Nixon’s associates for conspiracy and obstruction of justice in the Watergate scandal, the Special Prosecutor sought audio tapes of conversations between the President and his aides. The Special Prosecutor obtained a subpoena duces tecum, directing the President to produce the tapes for use in the upcoming criminal trial. President Nixon moved to quash the subpoena, asserting an absolute executive privilege over confidential presidential communications.
