The decedent, Charles Keitt, was in an alley behind the defendant’s (Peterson’s) house, attempting to remove windshield wipers from Peterson’s wrecked car. Peterson came out of his house and verbally protested. Peterson then went back inside, retrieved a pistol, and returned to his yard. By this time, Keitt had gotten back into his own car and was preparing to leave. Upon returning to the yard, Peterson loaded the pistol and shouted, “If you move, I will shoot,” and then, while standing just inside his gate, said, “If you come in here I will kill you.” In response, Keitt exited his car, retrieved a lug wrench, and advanced toward Peterson with the wrench in a raised position. Peterson warned Keitt to stop, but when Keitt continued forward, Peterson shot and killed him from a distance of about ten feet. Peterson was indicted for second-degree murder but convicted by a jury of the lesser included offense of manslaughter after raising a claim of self-defense.
