Aberdeen at Ormond Beach is a mobile home community for persons aged 55 or older. Its recorded Supplemental Declaration of Covenants prohibits individuals under 18 from permanently residing in the community. An earlier, unrecorded “Primary Declaration” purported to give the developer a general right to amend all covenants, but the court found it ineffective. Volusia County enacted an ordinance imposing a countywide public school impact fee on all new dwelling units to fund school construction, calculated using a “student generation rate.” Aberdeen paid $86,984 in fees under protest and filed suit, arguing the fee was unconstitutional as applied to its development. Aberdeen contended that because its legally enforceable deed restrictions prevent it from housing children, it does not generate any students and thus does not contribute to the need for new schools. The trial court granted summary judgment for Aberdeen, finding the fee unconstitutional as applied. The county appealed directly to the Supreme Court of Florida.
