Case Facts & Court Holding

Key Facts & Case Background

Earline Waddle sued her niece, Lorene Elrod, to set aside a quitclaim deed that had conveyed a one-half interest in Waddle’s property to Elrod, alleging undue influence. The day before trial, the parties’ attorneys negotiated a settlement. The terms required Elrod to convey her interest back to Waddle, for both parties to release all claims against each other, and for Waddle not to be responsible for court costs. Waddle’s attorney sent an email confirming these terms. Elrod’s attorney replied via email, stating, “That is our agreement,” with his name typed at the end. Relying on this exchange, the trial court cancelled the scheduled jury trial. Approximately three weeks later, Elrod refused to sign the formal settlement documents, claiming she had changed her mind. Waddle filed a motion to enforce the settlement agreement. Elrod responded, arguing that the agreement was unenforceable under the Statute of Frauds because it involved the transfer of real property and was not sufficiently memorialized in a signed writing.
