A witness observed Edward Welsh driving erratically before swerving off the road into a field. Before police arrived, Welsh walked away from the scene to his nearby home. The witness informed the responding officer that the driver appeared very inebriated or sick. Police identified Welsh from the car’s registration and, without obtaining a warrant, went to his house. They gained entry and found Welsh in his bedroom, where they arrested him for driving under the influence of an intoxicant. At the time, a first-offense DUI in Wisconsin was a noncriminal, civil forfeiture offense with no possibility of imprisonment. Welsh refused a breath-analysis test at the station.
