Johnnie Clemons executed a deed conveying a one-acre tract of land to Terry Cole, his deceased wife’s nephew. The conveyance was part of an informal testamentary plan for Cole to sell the property after Clemons’s death, pay debts, and distribute any remaining proceeds. Clemons informed Cole that he had executed the deed and, on several occasions, offered to give it to him for recording. Cole refused to take physical possession, telling Clemons, “you keep it for me,” partly to avoid conflict with other relatives. Clemons told Cole the deed was kept in a box in a bedroom. Throughout this period, Clemons retained exclusive possession of the unrecorded deed and continued to exercise all incidents of ownership over the property. The deed did not reserve a life estate for Clemons. After Clemons died intestate, his heirs found the deed in his house. Cole then obtained the deed and recorded it. Clemons’s heirs filed suit to set aside the deed, arguing it was never validly delivered.
