Legal Definitions - acceptance of service
Definition of acceptance of service
Acceptance of Service is a legal procedure where a party being sued (the defendant) or their attorney voluntarily agrees to receive legal documents, such as a lawsuit complaint or summons, directly from the opposing party or their attorney. This agreement eliminates the need for a neutral third party, like a process server or sheriff, to formally deliver the documents. By signing a specific acknowledgment form, the defendant confirms they have received the papers, satisfying the legal requirement that they be officially notified of the legal action against them.
This method is often used to streamline the legal process, save time, and reduce costs associated with formal service of process. While a defendant can refuse to accept service this way, doing so typically means they will be responsible for the additional costs incurred by the plaintiff to arrange for formal service.
Corporate Litigation: A large technology company, "InnovateTech," is being sued by a competitor, "Global Systems," for patent infringement. Instead of hiring a process server to deliver the lawsuit documents to InnovateTech's registered agent, Global Systems' attorney contacts InnovateTech's legal counsel. InnovateTech's attorney reviews the complaint and agrees to accept service on behalf of their client. They then sign an "Acknowledgment of Service" form, confirming receipt of all necessary legal papers.
This illustrates acceptance of service because InnovateTech's attorney voluntarily received the lawsuit documents, bypassing the formal process server, and signed a document to confirm this official notification.
Amicable Divorce Proceedings: Maria and David are separating and have agreed on most terms of their divorce. Maria's attorney drafts the divorce petition. To avoid the expense and formality of having a process server deliver the papers to David, David agrees to visit Maria's attorney's office. There, he reviews the petition and signs a document titled "Receipt and Acknowledgment of Service," confirming he has received the official divorce papers.
Here, David's action of personally receiving the divorce petition and signing the acknowledgment demonstrates acceptance of service, allowing the legal process to move forward without the need for a third-party server.
Small Business Dispute: A freelance graphic designer, Sarah, is suing a client, "Creative Marketing Agency," for unpaid invoices. Sarah's attorney prepares the lawsuit. Knowing that Creative Marketing Agency's owner, Mr. Henderson, is cooperative, Sarah's attorney reaches out to him directly. Mr. Henderson agrees to have the lawsuit documents emailed to him, and he prints, signs, and returns a "Waiver of Formal Service" form, confirming he has received and acknowledged the complaint.
This example shows acceptance of service as Mr. Henderson, on behalf of his agency, agreed to receive the lawsuit documents directly and provided a signed acknowledgment, thereby fulfilling the notice requirement without formal service.
Simple Definition
Acceptance of service occurs when a defendant or their attorney agrees to directly receive legal documents, such as a complaint, rather than requiring formal delivery by a process server or sheriff. This agreement is typically confirmed by signing an acknowledgment, which fulfills the due process requirement of notice and helps reduce litigation costs.
