Culpable neglect refers to a failure to exercise the care that a reasonable person would in a given situation, where this failure is serious enough to be considered blameworthy or legally inexcusable. It implies a degree of fault or responsibility for the resulting harm or oversight, often because the individual should have known better or had a duty to act differently.

Here are some examples illustrating culpable neglect:

• Imagine a property manager responsible for a large apartment complex. Despite receiving multiple written complaints from tenants about a dangerously loose handrail on a main staircase over several months, the manager repeatedly postpones repairs, citing budget constraints or staffing issues. Eventually, a tenant falls and sustains a serious injury due to the faulty handrail. This could be considered culpable neglect because the manager had a clear duty to ensure the safety of common areas, was aware of the specific hazard, and failed to take timely, reasonable action to prevent harm.
