If a person is incapacitated due to alcohol, drugs (including so-called "date rape drugs" like Rohypnol, GHB, or Ketamine), or is unconscious, they are legally unable to give consent. The presence of a prior relationship or social engagement does not imply consent for any sexual activity, and any sexual act without explicit consent is considered a crime.
