Simple English definitions for legal terms

dying without issue

Read a random definition: Trust Beneficiary

A quick definition of dying without issue:

Dying without issue means that a person has passed away without any children or other descendants who can inherit their property. It is also called failure of issue or default of issue. If someone dies without issue, their property will be distributed according to the laws of inheritance. In the past, there was confusion about what "die without issue" meant, but now it is generally understood to mean that at the time of the person's death, they had no living children or grandchildren who could inherit their property.

A more thorough explanation:

Definition: Dying without issue means that a person has passed away without any surviving children or other descendants who are eligible to inherit the person's estate. It is also known as failure of issue or default of issue.

For example, if a person dies without any children or grandchildren, they are said to have died without issue. In this case, their estate would be distributed according to the laws of intestacy, which determine how property is distributed when someone dies without a will.

The term "indefinite failure of issue" refers to a legal interpretation that was used in England, where a gift to "A and his heirs, but if A shall die without issue, to B and his heirs" meant that if A's line of descent ever came to an end, the property would go to B. However, most jurisdictions in the United States use the "definite failure of issue" interpretation, which means that the gift to B only takes effect if A has no surviving children or grandchildren at the time of their death.

Example: John passed away without any children or grandchildren. He died without issue, and his estate was distributed according to the laws of intestacy.

Explanation: John's death without issue means that he had no surviving descendants who were eligible to inherit his estate. As a result, his property was distributed according to the laws of intestacy, which typically prioritize spouses, children, and other close relatives.

I mean, idk how it's possible to end birth right citizenship without amending the constitution because to me the 14th amendment is pretty clear about it.
ross ulbricht tried to hire a hitman to kill 5 people
i am not that sympathetic to him

@KnowledgeableRitzyWasp: That might have been an FBI agent. It was most likely him and he was most likely doing it to retrieve stolen funds that corrupt FBI agents stole, but yeah moral gray area but me personally, cool with hitmen. It's not like it is uncommon to hire hitmen. I don't think the action itself is necessarily wrong but the intent behind it can be.

Like, Boeing whistblowers being killed by hitmen = wrong but a guy hiring hitmen to retrieve stolen funds = good to me.

@Dkk: Yeah, for sure. My guess is it'll go to SCOTUS and it'll be 8-1 or 7-2, saying that EO was unconstitutional.
