most-significant-relationship test

Read a random definition: court-martial

A quick definition of most-significant-relationship test:

The most-significant-relationship test is a rule used in legal cases to determine which state's laws should apply. The court considers factors such as where the injury or dispute occurred, where the parties live or do business, and where any contracts were made or performed. By looking at these factors, the court decides which state has the strongest connection to the case and should apply its laws. This rule helps ensure that the outcome of the case is fair and just for all parties involved.

A more thorough explanation:

The most-significant-relationship test is a legal doctrine used in conflict of laws cases. It helps determine which state law should apply to a dispute by considering which state has the most substantial connection to the occurrence and the parties involved.

For example, in a tort case, the court will consider where the injury occurred, where the conduct that caused the injury occurred, the residence or place of business of the parties, and the place where the relationship between the parties is centered. In a contract case, the court will consider where the contract was made, where it was negotiated, where it was to be performed, and the domicile or place of business of the parties.

For instance, if a person from California gets into a car accident while driving in Nevada, the court will consider where the injury occurred, where the parties reside, and where the car accident happened to determine which state's law should apply.

The most-significant-relationship test helps ensure that the state law applied to a dispute is the one that has the closest connection to the parties and the occurrence. This helps promote fairness and justice in legal proceedings.

I mean, idk how it's possible to end birth right citizenship without amending the constitution because to me the 14th amendment is pretty clear about it.
ross ulbricht tried to hire a hitman to kill 5 people
i am not that sympathetic to him

@KnowledgeableRitzyWasp: That might have been an FBI agent. It was most likely him and he was most likely doing it to retrieve stolen funds that corrupt FBI agents stole, but yeah moral gray area but me personally, cool with hitmen. It's not like it is uncommon to hire hitmen. I don't think the action itself is necessarily wrong but the intent behind it can be.

Like, Boeing whistblowers being killed by hitmen = wrong but a guy hiring hitmen to retrieve stolen funds = good to me.

@Dkk: Yeah, for sure. My guess is it'll go to SCOTUS and it'll be 8-1 or 7-2, saying that EO was unconstitutional.
