A nonresidential parent is a legal term used to describe a parent who does not have primary physical custody of their child. This means the child's main home is with the other parent, and the child lives with the nonresidential parent for less than the majority of the time. While the child does not reside primarily with this parent, the nonresidential parent typically retains important legal rights and responsibilities, including involvement in major decisions about the child's upbringing, and usually has court-ordered parenting time (visitation) and financial support obligations. This term is often used interchangeably with "noncustodial parent."

• Example 1: Standard Parenting Schedule
  After their divorce, Michael and Jessica agreed that their two children would live primarily with Jessica during the week to attend school. Michael has the children every other weekend, for several weeks during the summer, and on alternating holidays. In this scenario, Michael is the nonresidential parent because the children's primary home and daily residence are with Jessica, even though Michael has consistent and significant parenting time.

• Example 2: Long-Distance Co-Parenting
  Sarah and Tom separated, and Tom moved to a different state for a new job opportunity. Their daughter, Lily, remained living with Sarah in their original state. Tom visits Lily once a month and during school breaks, and they communicate frequently via video calls. Here, Tom is the nonresidential parent. Despite his active involvement and shared legal custody, Lily's primary physical residence is with Sarah in a different state.

• Example 3: Shared Legal Custody with Primary Residence
  David and Emily have a parenting plan where their son, Leo, lives with Emily from Sunday evening through Friday morning during the school year. David has Leo every Friday afternoon through Sunday evening. They share joint legal custody, meaning they make all major decisions about Leo's education and healthcare together.
