This means the contract might be governed by the laws in effect on October 1st, rather than the newer, stricter regulations, depending on the specific provisions of the new law regarding existing agreements.

• Example 2: Property Rights and Encumbrances

  A homeowner takes out a second mortgage on their property, which is recorded in the public land records on June 15th. Unbeknownst to them, a judgment lien from an old, unpaid debt against the homeowner was filed against the property by a creditor on May 1st. Here, the judgment lien predates the second mortgage. This temporal order is crucial because it generally means the judgment lien has priority over the second mortgage; if the property were to be sold to satisfy debts, the holder of the judgment lien would typically be paid before the second mortgage lender.
