Example 1: Opposing a New Trademark Application

"Morning Brew" believes that the new application is too similar to their existing mark and would confuse customers, potentially harming their brand. In this situation, "Morning Brew" would file an opposition with the TTAB, presenting evidence and arguments as to why "Mornin' Brews" should not be allowed to register its trademark. The TTAB would then hear both sides of the argument and decide whether the new trademark application should be approved or rejected.
Example 2: Seeking to Cancel an Existing Trademark Registration
Consider a scenario where "AquaClean Solutions" holds a registered trademark for a unique water filtration system. However, for the past six years, "AquaClean Solutions" has completely stopped manufacturing or selling any products under that trademark, and they have no plans to resume. Another company, "PureFlow Innovations," wants to launch its own water filtration system using the name "AquaClean" because it believes the original mark has been abandoned. "PureFlow Innovations" could file a petition for cancellation with the TTAB, arguing that "AquaClean Solutions" has abandoned its trademark through non-use.
