In a dissolution proceeding after a 20-year marriage, the husband was the sole earner with a gross income of approximately $36,000, while the wife, a homemaker, had recently earned a master’s degree but was unemployed. The parties had two children. The primary marital asset was the family home, valued at $40,000 but encumbered by two mortgages totaling $31,400. The parties also had significant other marital debts. The trial court awarded the home to the wife, who had custody of the children, and made her responsible for the first mortgage. It awarded the husband various personal property, his pension, and stock funds. However, the court ordered the husband to pay the second mortgage on the home awarded to the wife, as well as most of the other outstanding marital debts. The husband appealed, arguing this division was unjust because the debts assigned to him exceeded the value of the assets he received, resulting in a negative net award.
