Dora Donner, a Pennsylvania domiciliary, established an irrevocable trust in Delaware, naming Wilmington Trust Co., a Delaware corporation, as trustee. While in Florida, she executed a power of appointment over the trust assets. After her death, a dispute arose in Florida court between her daughters, who were residuary legatees under her will, and the beneficiaries of the trust appointment. The legatees sought to have the trust and appointment declared invalid. The Delaware trustee and other nonresident defendants were served by mail and publication but did not appear. The Florida court asserted jurisdiction, invalidated the trust, and ruled the assets passed through the will’s residuary clause. In a parallel proceeding, a Delaware court upheld the trust’s validity and refused to give full faith and credit to the Florida judgment, finding the Florida court lacked jurisdiction over the indispensable trustee and the trust property.
