Hermesmann was later adjudicated a juvenile offender for contributing to a child’s misconduct, stemming from the sexual relationship which constituted statutory rape under Kansas law, as Seyer was under the age of 16. After Hermesmann received public assistance, the Kansas Department of Social and Rehabilitation Services (SRS) initiated a paternity and support action against Seyer. The district court established Seyer’s paternity, ordered him to pay monthly child support, and entered a joint and several judgment against both parents for reimbursement of past public assistance. Seyer appealed, arguing that because he was legally incapable of consenting to the sexual act that resulted in conception, he could not be held financially responsible for the child.
