criminal procedure

Read a random definition: negative plea

A quick definition of criminal procedure:

Criminal procedure is the set of rules that the government follows when enforcing laws against people who have committed crimes. These rules outline how investigations are conducted, how evidence is collected, and how trials are run. They also protect the rights of the accused, such as the right to a fair trial, the right to an attorney, and the right to remain silent. After a trial, criminal procedure also includes the process of sentencing, which determines the punishment for the crime committed.

A more thorough explanation:

Definition: Criminal procedure refers to the set of rules that govern the process by which the government enforces criminal law. It includes the procedures for investigating, prosecuting, adjudicating, and punishing crimes. Each level of government has its own criminal code, and there are federal and state rules that outline the procedures for conducting criminal trials. Criminal procedure also includes the rules that law enforcement agencies must follow when investigating crimes, such as obtaining search warrants and conducting interrogations.

Example: When a person is suspected of committing a crime, law enforcement officers must follow certain procedures to investigate the crime. For example, they must obtain a search warrant before searching a suspect's property, and they must read the suspect their Miranda rights before conducting an interrogation. These procedures are designed to protect the suspect's constitutional rights and ensure that any evidence obtained is admissible in court.

Explanation: Criminal procedure is a complex area of law that involves many different rules and procedures. The examples provided illustrate some of the key aspects of criminal procedure, such as the need for law enforcement to obtain search warrants and read suspects their Miranda rights. These procedures are designed to protect the rights of suspects and ensure that any evidence obtained is admissible in court. By following these procedures, law enforcement agencies can help ensure that the criminal justice system operates fairly and justly.

I mean, idk how it's possible to end birth right citizenship without amending the constitution because to me the 14th amendment is pretty clear about it.
ross ulbricht tried to hire a hitman to kill 5 people
i am not that sympathetic to him

@KnowledgeableRitzyWasp: That might have been an FBI agent. It was most likely him and he was most likely doing it to retrieve stolen funds that corrupt FBI agents stole, but yeah moral gray area but me personally, cool with hitmen. It's not like it is uncommon to hire hitmen. I don't think the action itself is necessarily wrong but the intent behind it can be.

Like, Boeing whistblowers being killed by hitmen = wrong but a guy hiring hitmen to retrieve stolen funds = good to me.

@Dkk: Yeah, for sure. My guess is it'll go to SCOTUS and it'll be 8-1 or 7-2, saying that EO was unconstitutional.
