It occurs when someone misunderstands or overlooks their opponent's true position and instead argues against a different, often irrelevant, point. Essentially, it means arguing beside the point or proving something that is not material to the actual conclusion being debated.

• In a Legal Argument: Imagine a prosecutor presenting evidence to prove a defendant committed a specific act of theft. The defense attorney, rather than challenging the evidence of theft, spends their entire argument emphasizing the defendant's excellent character, their volunteer work, and their contributions to the community.
