Passive negligence is a type of negligence where a person fails to act or omits to do something that a reasonable person would have done in a similar situation. It is a failure to exercise the standard of care that is required to protect others from harm. Passive negligence is also known as ordinary negligence or simple negligence.
For example, if a property owner fails to remove a hazardous condition from their property, such as a broken step, and someone is injured as a result, the property owner may be held liable for passive negligence.
