Crucially, legal carelessness is judged by an objective standard of conduct; it is about whether the actions themselves met the expected standard, rather than what the individual subjectively intended or felt.

• Scenario: A homeowner knows that a section of their garden path has become uneven and loose over time, creating a tripping hazard. Despite noticing this issue weeks ago, they repeatedly postpone repairing it. One day, a visitor trips on the uneven path, falls, and breaks their wrist.

  Explanation: The homeowner demonstrated carelessness by failing to address a known hazard on their property that a reasonably prudent homeowner would have either fixed promptly or clearly warned visitors about. Their inaction (failing to repair or warn) falls below the objective standard of care expected to ensure the safety of guests.

• Scenario: An office worker, rushing to leave for the day, leaves a hot coffee pot plugged in and unattended on a fabric coaster near a stack of papers. Overnight, a short circuit in the coffee pot causes a small fire that damages office property.
