Pathological intoxication refers to an extremely rare and abnormal reaction to a small amount of alcohol or certain drugs, resulting in severe behavioral disturbances that are grossly out of proportion to the quantity consumed. This condition is characterized by a sudden onset of confusion, disorientation, aggression, paranoia, or other bizarre behaviors, often followed by complete amnesia for the event.

In a legal context, a person experiencing pathological intoxication might argue that they lacked the necessary mental state (known as mens rea) to commit a crime because their actions were involuntary and they were not in control of their faculties due to this extreme, unexpected reaction.

• Example 1: Sudden Aggression

  A man, who rarely drinks, sips half a glass of wine at a dinner party. Within minutes, he suddenly becomes uncharacteristically violent, shouting obscenities and attempting to physically assault another guest, before collapsing. The next morning, he has no recollection of the incident or his aggressive behavior.

  This illustrates pathological intoxication because a minimal amount of alcohol triggered an extreme, uncharacteristic outburst of aggression and confusion, followed by amnesia for the event, which is disproportionate to the small quantity consumed.

• Example 2: Extreme Disorientation and Paranoia

  A woman takes a single, prescribed dose of a new sedative medication. Instead of feeling calm, she experiences acute paranoia, believing her family members are conspiring against her. She then barricades herself in a room, causing damage to the door, and later has no memory of her actions or the intense fear she felt.

  This demonstrates pathological intoxication as a standard, small dose of medication led to a severe, irrational mental disturbance (paranoia and disorientation) and destructive behavior, which was completely out of character and for which she later had no recall.

• Example 3: Bizarre Public Behavior

  During a celebratory toast, an individual takes a small sip of champagne. Moments later, they begin to loudly sing nonsensical songs, remove articles of clothing, and attempt to direct traffic outside the venue, drawing significant public attention. They have no history of such behavior and later cannot remember anything that happened during that period.

  This example highlights pathological intoxication through the sudden onset of highly unusual and bizarre public behavior after a negligible amount of alcohol, which is entirely uncharacteristic for the individual and accompanied by subsequent amnesia.
