A culpable accident refers to an unforeseen and unintended event that results in harm, but for which one or more parties are considered legally blameworthy due to their failure to exercise reasonable care. Unlike a pure accident where no one is at fault, a culpable accident occurs because someone acted negligently, recklessly, or failed to meet a required standard of conduct, thereby contributing to the incident. While the harm itself was not intended, the actions or inactions leading to it demonstrate a degree of fault.

• Imagine a delivery driver, running late, decides to quickly check a text message while driving through a residential neighborhood. Distracted, they fail to notice a child's bicycle left near the curb and swerve, hitting a parked car. The driver did not intend to hit the car, making it an accident. However, their decision to text while driving constitutes a failure to exercise reasonable care, making the incident a culpable accident. The driver's negligence directly led to the collision.
