The neighbor has never marked the boundary, and the homeowner genuinely believes all the land they are tending is their own.This illustrates innocent trespass because the homeowner is on the neighbor's property without permission (trespass), but they are completely unaware of the boundary line and have no intention of encroaching or causing harm (innocent).
Example 2: Erroneous Delivery
A package delivery driver is attempting to deliver a parcel to 123 Oak Street. Due to similar house numbers and a lack of clear signage, the driver mistakenly pulls into the driveway and walks up to the front door of 125 Oak Street, believing it to be the correct address. They realize their mistake only when they see the house number on the door.This is an innocent trespass because the driver entered private property (the driveway and porch of 125 Oak Street) without authorization (trespass), but did so purely by mistake, without any intent to intrude or cause trouble, and genuinely believed they were at the correct location (innocent).
Example 3: Unmarked Hiking Trail
A group of hikers is enjoying a scenic trail in a rural area. The public trail is not clearly marked at a certain point, and a section of it appears to veer slightly onto what is actually private ranch land. The hikers, following what they believe to be the designated path, unknowingly walk across a corner of the private property for a short distance before realizing the trail marker reappears further along, indicating they had strayed.This demonstrates innocent trespass because the hikers were on private property without permission (trespass), but they had no knowledge that they had left the public trail and certainly no intention to intrude on private land, believing they were following a public right-of-way (innocent).
