Manufacturer

A manufacturer is an individual or company primarily involved in creating or assembling new products. The legal definition also extends to include entities that distribute these new products on behalf of, or under the control of, the original creator. Additionally, it encompasses businesses that import new products into a country specifically for the purpose of selling them again.

Here are some examples to illustrate this concept:

• Imagine "GreenTech Motors," a company that designs and builds electric bicycles from scratch, sourcing raw materials like aluminum and rubber, and then fabricating the frames, assembling the components, and installing the electrical systems. GreenTech Motors is a manufacturer because it is directly engaged in producing new products (electric bicycles).

• Consider "Global Gadgets Inc.," a company that purchases various electronic components—such as microchips, screens, and batteries—from different suppliers worldwide. Global Gadgets then assembles these components into brand-new smartwatches, which it sells under its own brand name. Global Gadgets Inc. is considered a manufacturer because its core activity is assembling new products from various parts.

• Think of "HomeGoods Importers," a large retail corporation that imports a unique line of high-end espresso machines from an Italian factory. HomeGoods Importers then sells these machines in its stores across the country, often branding them with its own store label. Even though HomeGoods Importers did not physically produce the espresso machines, it is legally considered a manufacturer under the broadened definition because it imports new products for resale.
