negligent misrepresentation

Read a random definition: affiant

A quick definition of negligent misrepresentation:

Negligent misrepresentation is when someone makes a false statement without intending to deceive, but they should have been more careful. This can happen through spoken or written words, or even through actions. The false statement can be innocent or unintentional, but it can still cause harm to the person who relies on it.

A more thorough explanation:

Definition: Negligent misrepresentation is when someone makes a false or misleading statement without intending to deceive, but they should have taken more care to ensure the statement was true. This can include spoken or written words, as well as any other conduct that amounts to a false assertion.

Examples:

  • If a real estate agent tells a potential buyer that a house has a new roof, but they didn't actually check to see if it was true, that could be considered negligent misrepresentation.
  • If a car salesman tells a customer that a used car has never been in an accident, but they didn't check the car's history report, that could also be considered negligent misrepresentation.

These examples illustrate how someone can make a false statement without intending to deceive, but they still have a responsibility to ensure the statement is true. If they don't take reasonable care to verify the statement, they can be held liable for any harm caused by the false statement.

I mean, idk how it's possible to end birth right citizenship without amending the constitution because to me the 14th amendment is pretty clear about it.
ross ulbricht tried to hire a hitman to kill 5 people
i am not that sympathetic to him

@KnowledgeableRitzyWasp: That might have been an FBI agent. It was most likely him and he was most likely doing it to retrieve stolen funds that corrupt FBI agents stole, but yeah moral gray area but me personally, cool with hitmen. It's not like it is uncommon to hire hitmen. I don't think the action itself is necessarily wrong but the intent behind it can be.

Like, Boeing whistblowers being killed by hitmen = wrong but a guy hiring hitmen to retrieve stolen funds = good to me.

@Dkk: Yeah, for sure. My guess is it'll go to SCOTUS and it'll be 8-1 or 7-2, saying that EO was unconstitutional.
